Terms of Service

By accessing or using TradeInsights (the "Service" or "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

• You must be at least 18 years of age to use the Service.
• You represent that you have the legal capacity to enter into a binding agreement.
• If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

TradeInsights is a trading journal, analytics, and performance tracking platform. The Service includes: trade logging, automated broker synchronisation, AI-powered analytics and insights, bar-by-bar backtesting simulation, prop firm challenge tracking, peer benchmarking, developer API access, performance reports, risk management tools, and mobile/desktop access.

The Platform uses artificial intelligence to generate analytics, insights, pattern recognition, and performance observations. You acknowledge that:

• AI-generated content is for informational and educational purposes only.
• AI outputs may contain errors, inaccuracies, or misinterpretations of data.
• You must not rely on AI-generated insights as the sole or primary basis for any trading or investment decision.
• The Platform makes no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.
• Past performance analysis does not predict or guarantee future results.
• All trading and investment decisions are made at your own risk and discretion.
• Multiple AI models may be used to generate responses. The Platform selects outputs algorithmically and does not guarantee consistency across sessions.

The Platform provides a bar-by-bar backtesting engine that allows you to replay historical market data and simulate trading decisions. By using this feature, you expressly acknowledge and agree that:

• Simulated results only. All backtesting results are hypothetical and simulated. They do not represent actual trading or investment results and have not been achieved with real money.
• No guarantee of future performance. Hypothetical or simulated performance results have inherent limitations and do not predict or guarantee future results in any way.
• Idealised conditions. Backtests are conducted under idealised conditions that do not account for real-world factors including, without limitation: slippage, market impact, liquidity constraints, partial fills, brokerage fees, psychological trading biases, or changes in market conditions.
• Data limitations. Historical price data used in backtests is sourced from third parties and may be incomplete, delayed, adjusted, or inaccurate. TradeInsights makes no warranty regarding the accuracy or completeness of historical data.
• Not a trading system. The backtesting tool is a journaling and educational aid. It does not constitute a trading system, signal service, or investment strategy.
• User responsibility. You are solely responsible for any real-world trading decisions informed by backtesting results. TradeInsights and its owner(s) shall not be liable for any financial losses, trading losses, or other damages arising from your use of or reliance upon backtesting outputs.

The Platform includes a tool for tracking funded account and prop firm challenge progress. You acknowledge that:

• Record-keeping only. The Prop Firm Challenge Tracker is a personal record-keeping tool. It does not communicate with, endorse, or have any affiliation with any proprietary trading firm unless explicitly stated.
• Challenge rules are user-defined. Account parameters, drawdown limits, profit targets, and other challenge rules displayed in the tracker are entered or selected by you. TradeInsights does not guarantee that these parameters reflect the current or actual rules of any proprietary trading firm.
• No real-time risk management. The Platform does not monitor live trading accounts in real time for the purpose of enforcing risk rules. You remain solely responsible for monitoring your own account and complying with your prop firm's rules.
• No liability for challenge failures. TradeInsights shall not be liable for any funded account suspension, challenge failure, payout denial, or financial loss arising from your use of, or reliance upon, the Challenge Tracker.
• Verify directly. You should always verify challenge rules and account status directly with your prop firm using official documentation and account portals.

Premium and Pro subscribers may opt in to the Anonymous Peer Benchmarking feature, which compares your aggregated performance metrics against those of other opted-in users. You acknowledge that:

• Opt-in only. Participation is entirely voluntary. You may enable or disable benchmarking at any time in Settings. Disabling benchmarking removes your data from future aggregations.
• Anonymised data only. Your individual data is never shared with other users. Only anonymised, aggregated statistical distributions (e.g., percentile ranges) are used in comparative displays.
• Limited population. Benchmarks reflect only the population of opted-in TradeInsights users and do not represent all traders, any market segment, or any professional benchmark.
• Not investment advice. Percentile rankings, Trader Scores, and comparative metrics are for self-reflection and informational purposes only. They do not constitute investment advice, trading recommendations, or performance guarantees.
• Data accuracy. Benchmarks are based on data entered or imported by users. TradeInsights does not independently verify the accuracy of user-submitted data.

Nothing on the Platform constitutes financial advice, investment advice, trading advice, or any other sort of professional advice.

• The Platform does not recommend any specific investments, securities, trading strategies, or courses of action.
• You should consult with a qualified financial adviser, broker, or other professional before making any financial decisions.
• The Platform's analytics, charts, metrics, reports, backtesting outputs, AI insights, and peer benchmarks are tools for self-reflection and record-keeping, not recommendations.
• The mention or display of any security, asset, or instrument does not constitute a recommendation to buy, sell, or hold.

• You must provide accurate, current, and complete registration information and keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify TradeInsights immediately at info@tradeinsights.io of any unauthorised use of your account.
• TradeInsights reserves the right to suspend or terminate accounts that violate these Terms.

The Platform connects to third-party brokerages via APIs to import your trade data.

• TradeInsights is not affiliated with, endorsed by, or partnered with any brokerage unless explicitly stated.
• You authorise TradeInsights to access your brokerage data via read-only API connections that you configure.
• TradeInsights does not store brokerage login passwords. Connections are made via OAuth tokens or read-only API keys provided by you.
• TradeInsights is not responsible for: (a) errors or inaccuracies in brokerage data; (b) delays in data synchronisation; (c) interruptions in brokerage API availability; or (d) changes to brokerage API terms.
• You are responsible for verifying the accuracy of all imported trade data.

The Platform provides a public REST API (available at /api/v1) and an MCP (Model Context Protocol) server for programmatic and AI-assistant access to your trading data. By using these features, you agree that:

• Authentication. API access requires a valid API key tied to your account. You are responsible for keeping your API keys secure. Do not share keys publicly or embed them in client-side code.
• Rate limits & usage quotas. API access is subject to rate limits and monthly usage quotas based on your subscription tier (Sandbox, Developer, Pro). Exceeding these limits may result in temporary suspension of API access.
• Permitted use. API and MCP access is granted solely for your own personal or internal business use. You may not use the API to build products that compete directly with TradeInsights, resell API access, or aggregate data from multiple user accounts without explicit written authorisation.
• No warranty on API availability. TradeInsights does not guarantee uninterrupted API availability. The API may be modified, rate-limited, or discontinued with reasonable notice.
• Same disclaimers apply. All data returned via the API is subject to the same accuracy disclaimers, AI disclaimers, and liability limitations that apply to the Platform generally. Decisions made by you or automated systems using API data are made at your sole risk.
• Revocation. TradeInsights may revoke API keys or suspend API access at any time for abuse, violation of these Terms, or fraudulent activity.

While TradeInsights strives to accurately import and display trade data, the Platform does not guarantee the accuracy, completeness, or timeliness of any data.

• Calculations including profit/loss, win rates, risk metrics, portfolio analytics, backtesting results, and peer benchmarks are provided for informational purposes and may contain errors.
• You should independently verify all data and calculations before relying on them for any purpose.
• Discrepancies between Platform data and brokerage records should be resolved by reference to official brokerage statements.

• The Service is offered on a subscription basis. Current pricing: Premium at $24/month, Pro at $49/month.
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• You may cancel at any time through your account settings; cancellation takes effect at end of the current billing period.
• No pro-rated refunds are provided for partial billing periods except as required by applicable law. See our Refund Policy for details.
• TradeInsights reserves the right to change pricing with 30 days' advance notice.
• If payment fails, TradeInsights may suspend access until payment is resolved.
• 14-day free trials. Where a free trial is offered, you may be required to provide a valid payment method before the trial begins. No charge is made during the trial period. At the end of the trial, your payment method will be charged the applicable subscription fee unless you cancel before the trial expires. If you choose crypto payment for a trial, no automatic charge is made; instead, an invoice is emailed near the end of the trial period.
• Developer API plans. Standalone API subscriptions (Developer, Pro API tiers) are billed separately from journal subscriptions and are subject to the same billing and cancellation terms above.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Scrape, crawl, or use automated means to extract data from the Service without prior written consent.
• Resell, redistribute, or commercially exploit the Service or any data obtained from it.
• Interfere with or disrupt the Service's infrastructure, servers, or networks.
• Attempt to gain unauthorised access to other users' accounts or data.
• Use the Service to develop a competing product or service.
• Upload malicious code, viruses, or other harmful material.
• Misrepresent your identity or affiliation with any person or organisation.
• Share account credentials or API keys with third parties.
• Use the backtesting engine or API to fabricate, falsify, or misrepresent trading performance records.

• All content, features, functionality, software, algorithms, AI models, designs, and trademarks of the Platform are owned by TRADEINSIGHTS JOURNAL LTD and protected by applicable intellectual property laws.
• You retain ownership of your own trade data.
• By using the Platform, you grant TradeInsights a limited, non-exclusive, royalty-free licence to process your data solely for the purpose of providing the Service.
• You may not copy, modify, distribute, or create derivative works of any Platform content without prior written permission.

You agree to indemnify, defend, and hold harmless TRADEINSIGHTS JOURNAL LTD and its owner(s), officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: your use or misuse of the Service; your violation of these Terms; your trading or investment decisions; your use of backtesting results, AI insights, challenge tracking data, peer benchmarks, or API outputs; your violation of any applicable law or third-party rights; or any content or data you upload to the Platform.

• Any dispute shall first be attempted to be resolved through good-faith negotiation for 30 days.
• If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
• Arbitration shall be conducted in Delaware.
• Class Action Waiver: Dispute resolution proceedings will be conducted only on an individual basis — not in a class, consolidated, or representative action.
• The arbitrator's decision shall be final and binding.

These Terms shall be governed by the laws of Delaware, without regard to conflict of law principles. Legal proceedings not subject to arbitration shall be brought exclusively in the courts of New Castle County, Delaware.

• TradeInsights may suspend or terminate your account at any time, with or without cause or notice.
• Upon termination: your right to access the Service ceases immediately; TradeInsights may delete your data after a 30-day retention period; Sections 14–19 survive termination.
• You may terminate your account by cancelling your subscription and requesting account deletion in Settings.
• API keys associated with a terminated account are revoked immediately upon termination.

• TradeInsights reserves the right to modify these Terms at any time.
• Material changes will be communicated via email or prominent notice at least 30 days before taking effect.
• Continued use of the Service after changes take effect constitutes acceptance.

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms constitute the entire agreement between you and TradeInsights regarding the Service.
• Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign your rights. TradeInsights may assign freely.
• Force Majeure: TradeInsights is not liable for delays or failures due to circumstances beyond its reasonable control.
